You would sue them for the money you are owed. Whether you are working as an employee or as an independent contractor (e.g. freelancer), you must be paid for the work you did. When you are not paid, you can sue. You would need to show, whether by documenation, testimony, or other evidence, that you did the work and the rate or amount you should have been paid. Depending on how much you are owed, you either sue in small claims, acting as your own attorney, or hire an attorney to represent you. (Probably unless it exceeds $2,500, it's not worth hiring a lawyer.) Good luck.
