In UT a Class A misdemeanor can be expunged after 5 years from the date that the petitioner was convicted or released from incarceration, probation or parole, whichever occurred last.
Note: If the petitioner has 2 different Class A misdemeanors, the second offense cannot be expunged.
At this point, you will want to consult with a criminal law attorney that specializes in expungments. While you could file yourself, it is time-consuming and tedious. Having an experienced lawyer help you with this will ensure it is done correctly and filed as soon as legally allowed.
