Can I get my file from my previous employer?

My boss lied about my activities and stated that I commited time fraud and I was fired. This is a lie and the computers will show whose password was used to modify time. I know it was not me. I want to sue for defamation of character in small claims but do I just go in and ask for my file?

Under the California Labor Code, you are entitled to receive a copy of certain employment documents and records upon request.  Please contact me at (213) 381-6557 or email me at ([email protected]), and I will provide you with a template request for your personnel file that includes all relevant code section.  Happy Holidays!
