As a matter of fact it can. In an" at will" employment realtionship, an employer can generally set the terms and conditions of employment as it sees fit; this can include what you can or cannot do once you are off the clock. For an employee's part, they can choose to coninue to work for their employer or not.
The above holds true unlesss such action on the part of the employer violates its own company policy or the terms of a union agreement or employment contract. Also, such action cannot be the result of any legally actionable form of discrimination.
