Unfortunately, a doctor's note is not legally binding on an employer. In other words, they can choose whether or not to honor it, notwithstanding an employment contract or union agreement to the contrary. The fact is that absent some form of legally actionable discrimination, a company can set the terms of work much as it sees fit. Furhter, as an "at will" worker, your son could have been terminated for this reason, any reason or no reason at all, with or without notice.
