If your insurance carrier will not pay to have your defective chimney fixed on a home that you purchased in 1997 due to "builder's error", there really is not much that you can do other than hire a mason to make the necessary repairs. The reason is that the 10 year statute of limitations for new construction (at least in California) has already run.
