So long as your boyfriend is not listed as a tenant on the lease that you and your brother signed, your boyfriend essentially has no rights to remain in the unit you have from a legal perspective. For your boyfriend to be removed from the unit where you are a listed tenant, both you and your brother have to agree to this third person's leaving.
