You can date just about any aged person as you wish so long as there is no sexual conduct if the other person is under the "age of consent" (i.e. the age at which consent for sexual relations can legally be given; in NY that's 16). That having been said, you are opening yourself up to potential criminal charges if you do go ahead and have sex with this minor. The fact is that having sex with somone this young will bring even more severe penalties.
