How do I recover back rent on my property that the property manager has taken?

I had a property manager managing my property since I’m away on military orders. The tenants have been paying but the property manager has not been depositing my rent into my account.

If the property manager has not been depositing your tenant's rent checks into your bank account but has been keeping the money for himself or herself, you need to make a written demand for the money owed you to be paid by a certain date.

If not presented to you in a timely manner, your recourse would be to file a legal action. Depending upon the amount at issue, small claims may be the route that you take. I would also terminate the property manager and advise your tenants in writing as well.

I would also make a police report about the presumed theft of rental money by the property manager. Do not use the threat of a criminal matter as leverage against the property manager to get your money back.
