Under CO law, getting charged with a DUI with a child in the car is considered child abuse. It applies to any child under 16. If the child in the car is not injured, it is considered misdemeanor child abuse; if the child is injured or dies, it is felony child abuse and you can be sent to prison. At this point, you should retain a DUI attorney who practices in the area of where this occurred; any time that criminal charges are involved it is highly adviseable.
