If I’m not divorced or legally seperated but do not live with my husband, does he have any rights to a home that I am looking to purchase?
I am looking to buy a mother/daughter home with my sister. Does my spouse have any rights to the house since we are still married?

In Massachusetts, spouses don't automatically get rights in the other spouse's property. However, a probate court judge, in a divorce, can award any portion of one spouse's propety to the other. While some retirment assets may be exempt from the division of assets in a divorce, real estate is not exempt.
