Texas has three types of courts which handle probate cases, depending on each county’s law: County Courts at Law, Constitutional County Courts, and specialized Probate Courts. In some counties, more than one court has jurisdiction over probate matters. Generally, if a (constitutional) county court has jurisdiction over probate, the district court will have jurisdiction and oversight over contested matters.
