Depends upon if there is a surviving parent and or whether the deceased left a will or trust designating the receiver of the assets of their estaste. If no surviving parent/ spouse, and no disposition documents changing the direction of the disbursement of the assets such as a will or trust, then the children of the deceased are the heirs of the deceased parent.
