An "uncontested" divorce, versus a "contested" divorce, is when both spouses agree to all issues regarding the dissolution of the marriage. That is, they both want the divorce and agree as to the grounds for the divorce, spousal maintenance and equitable division of the marital property, as well as custody, visitation and child support matters. Assuming all such issues can be resolved before the divorce is filed, neither party need appear in court and the divorce can be filed as "uncontested".
