What do I have to do get my name changed back from a non legal marriage

I married a man who I found out was never legally divorced. I have since decided to part ways with him because of this. I have changed my name to his and now since I know we are NOT married I want my old name back. Do I have to go through the court to have my name changed back

You should consider going to court to have the marriage declared void and a nullity so that it is clear in legal documents from hence forward.  You can ask at that time to have your name resume to your maiden name.  Good luck.
