In order to perfect a claim to sue one's employer for harassment in the work place, an employee needs to contact the local Department of Fair Employment and Housing and make a grievance. From there the DFEH either makes a complaint on your behalf or then gives you a right to sue letter. I suggest that you consult further with a labor law attorney about you matter.
