What needs to happen is an establishment of paternity. He needs to either have an affidavit executed regarding same or have a court order establishing paternity. Once that happens he has the same parental rights as the Mother and the same obigations as to support. Until that time the Mother is the one who is presumed to have sole custody of the child.
