Landlord must maintain the rental property as to make it habitable. If the code violation is minor, it would not affect the habitability of the property. To affect habitability, the violation must be substantial and severe. Check the code in your jurisdiction to see whether the violation is listed as one of the condictions to make the property inhabitable. If so, you can do a number of things such as rent strike or moving out and suing for damage. You must consult a local attorney to find out which conduct is permissible under the law in your jurisdiction and your possible course of action.
