If we hired a contractor that took our down payment and did not render service, how do i get my money back legally?

I am assuming here that you have a written contract, correct?  Please read the terms of the contract and see if they address a breach, which is what happened here.  If you just want monetary compensation (your deposit back) you could sue in small claims court depending on the amount.  Small claims has limits. In Illinois is it $10,000 plus costs so the amount of the deposit can not exceed $10,000.  Good luck.
