If we have a mice infestation, can we terminate our lease early?

I sent an email over a month ago and called 3 times with no response.

Unless the presumed written lease that you have with the landlord specifically states that you can terminate your lease as a result of rodent infestation, you cannot legally terminate your lease as a result of this problem without any legal recourse from the landlord at this time.

Since your landlord is not responsive to your requests for elimination of the rodent problem, I would write him one more time as well as call him or her requesting a solution in the next 5 days or you will contact the public health department for an inspection of the rental. If you receive no response, contact the public health department for an inspection and see what its solution is to your problem.

In the interim, you might wish to consult with a landlord tenant attorney about your situation.
