If our neighbors took out our property line tree marker and our survey post, what can we do about it?

We own 39 acres. he neighbor is digging their foundation and are very close to our property line. They took out the property line tree marker and our survey post.

Under the laws of all states in this country, a person who is not a surveyor who deliberately removes a boundary marker could be subject to criminal charges.
