We own 39 acres. he neighbor is digging their foundation and are very close to our property line. They took out the property line tree marker and our survey post.

Under the laws of all states in this country, a person who is not a surveyor who deliberately removes a boundary marker could be subject to criminal charges.
In your situation, I suggest that you consult with a real estate lawyer concerning sending a demand letter to your neighbors about the need to reinstate the boundary marker at its true location at their cost. Depending upon their response, you act accordingly based upon the advice of your attorney.
