ok my 10 yr old was sexually abused continuously since she was 8 years old the man has been charged with 1 count for sexual assault and 2 counts for

sex abuse continuous with a child under 14 yr of age. He is denying it. His son is possibly hiring an attorney. We will have to hire an attorney? or does the district attorney get involved? How much time could he get will he just stay in jaill or go to prison? he is a first time or should I say first time getting caught. He is also an illegal immigrant and hold has been placed on him from immigration. Will he serve his time or could he possibly just get deported? Is there a possibility he could just get a slap on the wrist and be set free?

The local prosecutor represents the people of the State of Texas and prosecutes crimes under Texas law. The prosecutor has extensive discretion as to who s/he prosecutes and what charges s/he brings, and what charges s/he would accept a plea bargain for.  The prosecutor handles it all and you do not need a lawyer for the criminal aspects.

IF the person has significant assets you may want to speak with a private lawyer about bringing a civil action for damages against the perpetrator, but even talking about that can damage the prosecutor's case, so don't do anything along that line on your own.
