I was injuried in an automobile accident on 12/10/2008 I had to receive chiropratic care for 6 wks and just received an offer from the insurance company to settle for $5900 after the medical deduction and wages I am to receive about less than half of the $5900 I don’t feel that is a fair offer my vehicle was total loss and 5 days later I was laid off from my employer do the math…..does’nt seem fair

What a fair settlement is all depends on the specifics of a case. If you feel it is not fair you have the right to proceed to trial, as there is no rule that you must settle. I assume you have an attorney handling this matter for you

It is in the attorneys best interest to get as much as possible. If the attorney agrees this is unfair and that you should proceed than that makes sense if they advise to settle it is again your decision.

If you feel your attorney is not representing you fairly that is another issue but usually the client has the right to settle or not and ti is completely up to you
