The amount is being held bythe court as my son is still a minor. Can I claim the amount held by court as iIam migrating to another country for good?

No, you cannot: the settlement is in a trust for your *son's* benefit; changes in *your* country of residency have no legal bearing on that. The trust may only be used or distributed in accordince with the order, ruling, or settlement documents which created it.
