My mother died without a Will while still married to my father and he has failed to give me anything of hers, is there anything that I can do?
I asked him to open up an estate but he has failed to do so, telling me I do not deserve anything of hers.

Depending on how large your mother's estate is, you may be entitled to a portion of her estate under the laws of intestate succession since she died without a will. Under the law, you father (if he is your natural or adopted father) would inherit the first $60,000 of your mom's estate plus 1/3 of the balance. The remaining amount goes to the children.
