Do you mean trustee? If so, then he has a fiduciary responsibility to all beneficiaries and co-trustees to deal with the matter. If there is a vote required for sale of assets, real property and paying off creditors, then all need to be involved. If there is an issue with providing notice to other co-trustees and beneficiaries of what is going on, then you need to inform the court and file an action to remove your brother as agent or obtain an accounting.
