More than likely your husband will not be charged with possession because the other person in the vehicle has what's called "physical" possession of the drugs. This means that it was found on his or her person, which makes that person legally culpable. Where you husband can be charged is if he was found to be in possession of the marijuana by either smoking it, or if there were other drugs found throughout the vehicle.
