What to do if my husband was critically injured while cycling in a collision with an auto?

The driver’s auto insurance company has offered a settlement for “general damages” that is more than twice the cost of my husband’s medical bills ($118K not including copays), but not large enough to cover the entire claim. Driver’s auto insurance company also opened a UIM claim with our auto insurance company on our behalf (still unsettled). The medical subrogation company is offering to discount their claim 50% based on the amount of our settlement. Is it possible to negotiate a discount if the settlement is larger than his medical bills? My husband will require future therapy, doctor visits and potential surgeries.

WOW>  Alot going on.  My only advice is to retain a seasoned personal injury attorney to represnt you.  Yes, he will be paid, but the amount of the settelement will be commensurate with his efforts and you will still come out ahead without risking a cent.  Most  PI attorneys work on a contingency fee basis so you will spend nothing but benefit more.
