As long as the birth father is OK you can adopt the baby.  Both father and mother will have to sign consents.

If you can obtain the consent of the father, consider having both parents agree to a voluntary termination of their parental rights so that you can adopt the child.  Any family law attorney should be able to help you work through any paperwork before and after the child is born.

If mom does not want the child, but dad does, then his rights will trump your interests. That's why it's better to see if you can get a voluntary agreement.
