I assume that there was no Will. If there was then is terms will control the distribution of the estate. If there was no Will and o surviving spouse or children, then your brother's estate should have been eqully divided between you and your sister. Her son had no rights to anything. At this point, you should contact a local attorney and consult with them directly as to your next steps.
