If my daughter’s biological father hasn’t been around for 6 years, can I terminate his rights?

We were never married, there’s no court order child support, nothing has ever been done though a court to prove that he is the father (i.e. no paternity test). I am now married for 4 years and would like for my husband to be able to adopt our daughter that he has raised for the last 6+ years.

Under the laws of all states in this country, you cannot terminate the parental rights of the father of your child absent the express written consent of the biological father so that your current husband can adopt the minor.

I suggest that you consult with a family law attorney to see if the biological father is willing to sign off on all parental rights to the minor.
