Depends. In Ca you have to prove either the dealership caused the carper to be scrunched up or it had been in that condition for a sifficient period of time for the dealersip to have known about it or discovered it through a reasonable inspection. Also, if the condition was visible to your brother-in-law, he may have some fault as well.
