A $2 million jury award to the victims of a hospital’s negligence shows that medical malpractice lawsuits can bring a family the justice it deserves. Hospital’s Misdiagnosis Caused Permanent Blindness

Sixty-three year old Joseph Ginisi was admitted to St. Vincent Hospital in Worcester, Massachusetts in 2004 after experiencing dizziness. Doctors diagnosed him with vertigo, gave him medication and told him to follow up with his primary care physician.

Unfortunately, Ginisi’s condition only got worse. He underwent an MRI which showed that he had actually suffered a series of strokes. During the next two weeks, he began to lose his sight and his ability to speak. Confused and scared, his wife brought him back to St. Vincent Hospital where a brain biopsy revealed an intravascular lymphoma, a type of brain cancer.

He was transferred to Mass General in order to receive better care, but doctors had to wait to start that care because St. Vincent’s waited days to forward his medical records. Although Ginisi’s cancer is now in remission, he isn’t the same. Legally blind and unable to walk on his own, he is confined to a nursing home and is only able to come home sporadically. In short, his life is not what it used to be all because he wasn’t correctly diagnosed in the first place. Needless to say, he and his wife filed a medical malpractice lawsuit against St. Vincent’s Hospital and a jury ruled in their favor.

Jury Awards $2M In Medical Malpractice Lawsuit

After hearing evidence in the medical malpractice lawsuit, a jury awarded the Ginisi family $2 million. That included a $500,000 award to his wife for loss of consortium, which is the loss of physical relations, the inability to perform regular duties around the house, the inability to provide guidance to children and more.
