What to do if my landlord is evicting me over a swamp cooler?

The place I’m renting from the A/C units do not work well and the landlord won’t fix them, therefore I put a swamp cooler in the window of my bedroom. My landlord told me yesterday to take it out do the the fact he does not won’t to pay for the water and he afraid others in my 4-plex will do the same thing. I was leaving for school before he told me so I figured I would do it today because I come home from school around 11:30’pm. However, at 9 am today he had served me with an eviction notice because it was still in the window. Can he do that?

Whether or not you landlord can legally evict you over the swamp cooler issue depends upon what is stated in the presumed written lease you have for the rental that you have. As such, you need to carefully read the document in that it sets forth the obligations owed to you by the landlord and vice versa.

Your answer will be in the written lease assuming there is one. If you do not have a written lease, then you cannot be evicted over the swamp cooler issue.
