Is there standing to sue marketing agency after botched plastic surgery? The
surgery was scheduled through the marketing agency, and payment was issued to
them, not the doctor.

The medical malpractice law suit is a complicated one and you should seek help from a qualified attorney. There are stringent filing requirements in New York. Now, the marketing people can not be sued for the actual malpractice (becuase they are not doctors) but they may be able to be sued under contract and agency theories.
