Is spitting on someone consider domestic violence?

I was hit by my children’s mother and in my defense I spit on her. I was charged with domestic violence.

Spitting on your child's mother could be construed as domestic violence because it is battery.  Battery is the harmful or offensive touching of the person of another without consent or legal privilege.  Battery is both criminal and civil.  The criminal and civil cases are separate.
