In most states, it is illegal to record any conversation without express permission of the person being taped. Now, if this event occurred in a public place, there is no expectation of privacy and therefore it may be legal but it truly depends on the circumstances. Case law cannot be given here as it would be tantamount to legal advice; further, case law needed will depend on the facts of your case and which cases and laws most closely allign with your circumstances.
