Is a new marriage validif the first marriage was not finalized?

My husband and I got married when we thought that his divorced from a previous marriage was finalized. Soon after when we are doing my paperwork for immigration purposes, we found put that it was not legalized. They finalized the divorce 5 months after. Is our marriage annulled or not valid due to the fact that he was not legally divorced at the time we got married? Do we have to file for annulment and refile for marriage?

You just answered your own question. Your marriage is invalid such that you have to annul it and remarry.
