If the family member is on your auto insurance policy, your insurance should accept the other driver's claim.  You are also liable for the accident because you are the registered owner of the vehicle even if you were not present when the accident occurred.
If the family member is not on your auto insurance policy, your insurance will deny the claim because the family member, according to the insurance, is not an authorized driver.
Since a lawsuit was filed, that indicates that the case was not settled with your insurance company.  Although the case could still settle, a settlement can't exceed policy limits.  The insurance company will offer considerably less than policy limits in settlement offers.
