Do I have a bad faith claim if I was damaged by my spouse’s insurance company’s refusal to pay?

An insurance company generally owes its insured a duty of good faith and fair dealing, but does not owe such a duty to third parties. This means that your insurance company owes a duty to your spouse–not to you. Unless you are the beneficiary of the insurance policy payments (like in the case of a life insurance policy), you generally cannot sue for bad faith unless one of the limited exceptions applies.
