Is it legal or not to record a private business conversation without knowledge or permission of the unaware party?

If not, what class of violation is it? The out of context recording is being used for a perceived advantage in a negotiation.

Hello. The answer depends on state law. Sometimes more than one state is involved, so the laws of both states must be examined.

Please seek private legal counsel. Some attorneys, myself included, will confer for free, at no charge. Then, if legal work is performed, some attorneys, myself included, will provide a reduced fee for need. All the best to you and your family.
