No it is absolutely illlegal for your employer to take sick days from you if you have earned them and not used them.  It would be a different story, however, if you took your days and your employer is properly deducting from your sick account. You should contact the labor department in your state about this matter and see if that agency has jurisdiction to handle this matter on your behalf or at least investigate this practice.
