Yes: if the breeder knew about the condition but, knowing of it, failed to disclose the condition and/or affirmatively lied about the puppy's health, the buyer could sue, based on fraud, to either rescind the sale (give puppy back, get money back) or to get the cost(s) of medical treatment for the puppy. A vendor may not lie about known defects with merchandise, including pets.
