If you are a Mississippi landlord who has notified your tenant that the lease has been terminated but the tenant will not leave the property, your next step is to file for eviction. You file for eviction by going to your local Justice Court and requesting the necessary paperwork from the clerk. The court will then serve a summons on your tenant and you will both come back to court to argue your sides. If you win, the tenant must leave your property. If the tenant does not leave, the court will have to issue a warrant for the Constable to help you physically remove the tenant. Remember, it is not lawful to force out your tenant yourself. You should always seek the help of the Constable and the legal system.
