It all depends on just what you mean by "digitized". If you are only responsible for all creative work and the digitizing is simply a mechanical act on the other person's part, then you should be the sole copyright owner. In other words, this other person would have no rights to any profits received by you. However, without more facts it's hard to say. At this point, you should consult directly with an attorney in your area.
