How can they charge $35 for the first day late and then $5 a day for every late day after that. How can we make the $700 every two week payments and get ahead?

I am sorry, I don't have access to your previous question.  Normally a landlord cannot charge excessive amounts ($35.00 per day late fee and $5 per day thereafter).  A landlord can usually charge a cap every month or a flat fee if late.  Then usually a process is made to evict the tenant.

I suggest you contact your state's attorney general's office and also a private counsel (plaintiff's landlord tenant attorney).  Try www.attorneypages.com and check his or her record at the Minnesota State Bar.
