If I was cited for having an open container because I threw out an empty beer can from my vehicle, shouldn’t I have gotten a littering ticket instead?

If you wre in a vehicle and it was throiwn from that vehcile and witnesses, that would, in fact be eevidence of a violation of the open container law.
