If I want to start a medical marijuana business pending legalization, is it legal to start planning for this business and bring in a lawyer?

Yes, it is legal to start the planning process; to consult with a lawyer or establish a business structure (e.g. an LLC), even to buy equipment or supplies which may be useful but which is not currently illegal (e.g. you could buy grow lights, which can used for many plants). What you can't do is do, buy, sell, trade, etc. a single thing currently illegal under the law; it  is doing an act which is (still) illegal which could result in liability.
