If I’m in a month-to month-lease, can my landlord evict me just because she wants to move back in?

My landlord is trying to refinance and the only way she can do that is if she lives at the house. We’ve been lying for her to bank investigators saying that she is our roommate because she threatened eviction if we did not do so. I have a 19 month old daughter and my wife is pregnant so I am really freaking out about getting evicted. What can I do? Can I sue her?

With a month-to-month lease, the landlord has the right to evict tenants on 30 days notice. You do not have any right to remain in her home after those 30 days--remember: it is her home, not yours, and she is entitled to possession of it on thirty days notice to a month-to-month tenant.
