What to do if I’ve been divorced for 5 years and my ex-wife was granted the home but she still has not refinanced?

She has remarried and the house they are living in is still in my name.

Before you file an expensive suit, however, you may want to consider hiring an attorney to simply send her a demand letter. Sometimes that letter will get the spouse motivated to do what is required.

Unfortunately, that really is your main option.  In more and more decrees, spouses are incorporating provisions for forced sales when the other spouse fails to re-finance as required.  If your decree doesn't have an automatic remedy, then you will have to take your ex-wife back to court to enforce the final decree.
